Delta 8 THC FAQs
Q: Is Delta 8 THC legal?
A: All hemp-based products became legal on a federal level with the signing of The Farm Bill in 2018. The main stipulations of the bill were that the products had to be derived from hemp and not marijuana and that those products could not contain more than 0.3% THC. The THC specified in this Bill is Delta 9 THC. This means that all other cannabinoids in the hemp plant, including CBD and Delta 8 THC, are federally legal.
However, each state can accept the federal government’s guidelines on the legality of a substance or create its own rules and laws concerning that item. The recent legalization of marijuana in many states, while it remains illegal on a federal level, is a perfect example of this. Currently, 17 states have made Delta 8 THC illegal within their borders. These laws are constantly changing and evolving, so it is advisable to check the laws in your state before purchasing or traveling into that state with Delta 8 THC.
Q: Is there a right time to take Delta 8 THC?
A: Because Delta 8 THC tends to leave the user with a clear head, most find that it’s OK to take Delta 8 at any time of day when you wish to experience its benefits. However, there are a couple of things to keep in mind regarding the timing of the onset of these effects.
Everyone’s body is unique in its chemistry and metabolism. Therefore, if there is a quick onset of the effects of Delta 8 THC for one person, those same effects could take hours for another person. The intensity of the experience and how long it lasts are also variable factors. This is why we recommend starting with a smaller dose and working your way up until you find the amount that is right for you.
The other timing variable is determined by whether you take the Delta 8 THC with a meal. In most cases, ingesting the Delta 8 on an empty stomach will bring on the effects fairly rapidly, but they will last a shorter amount of time than if taken on a full stomach. This is because when taken with meals, Delta 8 takes longer to enter the bloodstream. However, because more of the Delta 8 THC is absorbed over a longer period, the effects tend to be more intense and last much longer than if you took the Delta 8 on an empty stomach.
Q: Since it’s legal, can I drive after taking Delta 8 THC?
A: No. Driving or operating any heavy machinery after taking Delta 8 is not a good idea for several reasons.
First, while Delta 8 THC does not have as much psychotropic effect as Delta 9 THC (the cannabinoid found in abundance in marijuana), it still has an intoxicating effect. Depending on your body chemistry, this could likely impair your ability to drive.
Second, if you get pulled over and have to undergo a drug test, you could be arrested for having THC in your system. Delta 8 THC is federally legal across the U.S. However, even if you live in a state where Delta 8 is legal, you are still not allowed to drive with a certain amount of THC in your system. State law enforcement’s most common drug tests cannot distinguish between Delta 8 and Delta 9 THC. Therefore, even if you have the original packaging for your Delta 8, you are likely to run afoul of law enforcement for having THC in your system while driving.
